Guardianship
A guardian is appointed by probate court and completely takes over an incapacitated person’s decision making for certain rights. A guardian has strict reporting, training, and bond requirements. A conservator (in Texas) is appointed in family court, often for a minor child, to make decisions about the child’s residence, education, and finances. Guardianship for minors are usually only sought when a bank or other company or agency will only accept the authority of a guardian to distribute funds or grant access to benefits. Conservatorships are not usually an option for incapacitated adults outside of custody matters.
