A Small Estate Affidavit is a document that can be filed with the court in very limited situations to obtain a court order identifying a deceased person’s heirs. It is harder than it sounds to complete this process successfully. Many banks will tell people they can access accounts with a Small Estate Affidavit when the estate does not meet the legal requirements for a Small Estate Affidavit.
