Debt usually does not go away at death. In Texas, certain creditors are entitled to notice during the probate process. It is sometimes possible to shorten how much time a creditor has to pursue a debt through the probate process as well. The estate must settle valid debts before distributing assets to beneficiaries, which could affect inheritances. It is advisable to talk to an experienced probate attorney before paying a deceased person’s debt that you are not personally responsible for. Secured creditors, such as car lenders and mortgage companies, can still usually foreclose for nonpayment after the owner has passed away.
