Probate Avoidance
It is important to consult with an attorney who is experienced with both probate court and estate planning to ensure you are set up to avoid probate. Not only can you get bad information about how to avoid probate, but in some cases, avoiding probate can cause problems that are far worse than going to probate court. It is not recommended to attempt probate avoidance on your own if you have minor or disabled beneficiaries or beneficiaries who do not get along. In other words, just because you can, doesn’t mean you should.
