How long the process takes and how much it costs depends on many factors, including whether there is any conflict, whether there is a valid Will, how long it has been since the decedent died, how many beneficiaries or heirs are involved, whether any beneficiaries are under 18 or incapacitated, what types of assets and debts are involved, etc. A simple uncontested probate of an original Will within four years of death can take as little as 30-60 days, or as long as needed to handle all of the deceased person’s affairs. Without a Will, the process to appoint an administrator and establish the heirs of the estate usually takes at least 6 months to a year. If there is no Will and there are minor/disabled heirs or the family cannot agree on who will serve as administrator, this process rarely takes less than 2 years to complete.
