It depends. It is often necessary to hire a probate lawyer to establish who gets what and who is in charge of making sure everything is handled correctly. This usually happens through a special court process called “probate.” Even if the person who died had a Will, it is usually necessary to go to probate court to enforce it, especially if there are bank accounts or investments. Even if the estate only includes real estate, a court may still need to get involved. The most common reasons people hire probate attorneys is to access bank accounts that can only be accessed with “Letters Testamentary” or “Letters of Administration” or to sell property the person who passed away owned (even if it was co-owned with a spouse or someone else).
