Probate Fees
The cost of any type of court case varies depending on the specific circumstances of the case, including, but not limited to, the:
- type, amount, and value of assets;
- type, amount, and value of debts;
- the dynamics between the heirs, beneficiaries, personal representatives, and third parties;
- the documents involved (or lack thereof);
- the age/capacity of the heirs or beneficiaries;
- the number of the heirs or beneficiaries;
- any pending or anticipated lawsuits related to the estate;
- the skills and weaknesses of the personal representatives;
- how much communication with the client and/or other parties is required to complete the process;
- any issues that are anticipated or that pop up unexpectedly along the way.
Importantly, prices are not increased simply because an estate is larger. The fees are based on the amount of time and expenses required to complete the process.
While there are sometimes other options, the cost of a typical probate case with a Will generally starts at $4,000 in simple, uncontested cases ((including court costs, attorney’s fees, and typical expenses). Without a Will, the cost generally starts at around $7,000. Several factors impact the total cost, including the number and age of beneficiaries/heirs (and their willingness/ability to cooperate), the amount of debt, the assets of the estate, and how long it takes for the client to obtain the necessary information. The cost can be significantly higher when there are complications.
