The process of going to probate court after someone passes to “probate” a Will or establish heirs is not as bad in Texas as some states, but is still something many consider to be an expense and hassle they would rather avoid. One well-known strategy to avoid probate is a Living Trust, which is the most flexible option. Sometimes other strategies such as Transfer on Death Deeds or Ladybird Deeds and pay-on-death beneficiary designations (POD) can be useful, however, they are not right for everyone and are not enough by themselves. Using trust alternatives for beneficiaries who are minors, incapacitated, disabled, or just do not get along can have very costly consequences.
